When insurers refused to pay, our lawyers challenged their decisions. These are three of the clients we helped.

Sandra Bullock, whose disability benefits were reinstated

Sandra Bullock · Sun Life · Ontario

Her LTD Benefits Were Reinstated.

Sun Life said caring for her disabled son meant Sandra could work. James K. Fireman pushed back. After legal action and media coverage, Sun Life reinstated her LTD benefits.

Julie Austin, who challenged her long-term disability cutoff

Julie Austin · OTIP · Ontario

$113,000 After Her Benefits Stopped.

After a student assault left Julie with a brain injury, OTIP stopped her benefits. James K. Fireman used the insurer’s own surveillance to help show why she couldn’t work. Julie received $113,000 in compensation.

The Benefits and Compensation We Fight For

Unpaid benefitsRecovering the benefits you should have been paid while your claim was denied or your payments were stopped.
Monthly benefits restartedGetting your monthly payments started again when you still qualify under your policy.
A lump-sum settlementNegotiating a lump-sum payment to settle your claim. Before you decide, we’ll explain the offer and any future benefits you’d be giving up.

How Our Toronto Long-Term Disability Lawyers Help

We help people with disability insurance through work or a policy they bought themselves, including professionals and self-employed people. We take on the insurer so you can focus on your health.

We gather evidence showing why you can’t work, challenge the insurer’s reasons and negotiate for the benefits you’re owed. When a lawsuit is needed, we take the insurer to court.

Your Benefits Were Cut Off

Your payments stopped, but you still can’t work. We challenge the cutoff and work to recover missed payments, restart your benefits or negotiate a settlement.

You’re Facing a Two-Year Review

Your insurer says you can do another job. We check whether your health, work background and policy actually support that decision.

Your Medical Evidence Is Being Dismissed

We help show how your symptoms stop you from working, including when you’re dealing with mental health conditions, chronic pain or other invisible conditions.

You’re Unsure Whether to Appeal

Before asking your insurer to reconsider, talk to us. We’ll explain your options and check the deadline for taking legal action.

Just received a denial? Keep the insurer’s letter and contact us before deciding how to respond. You don’t need every medical record to get started.

“My case was complex and Albert Klein did everything to help me get through a disability claim. I was not in a position to pay an LTD lawyer and a contingency agreement was arranged. I can’t say enough of the professionalism.”

We Take On Disability Insurance Companies

Long-term disability insurance replaces part of your income when illness or injury prevents you from working. Your policy explains who qualifies, when payments start, how much you receive and how long they can continue.

Our lawyers take on major disability insurers. Choose your insurer below for more information, or talk to us about your claim.

Medical Conditions and Long-Term Disability Claims

Your condition doesn’t have to be visible. What matters is how it affects your work and whether you meet your policy’s definition of disability.

Mental Health

Brain Injury and Cognitive Symptoms

Pain and Physical Illness

We Help Show Why You Can’t Work.

A diagnosis is only part of the picture. We help get medical reports that explain how fatigue, medication side effects or trouble with memory and concentration affect your work. We use those details to challenge the insurer.

Toronto Long-Term Disability Lawyer FAQs

Have a question about your claim? Find answers below or talk to our team.

Ask Us About Your Claim

What Should I Do If My LTD Claim Is Denied?

Keep your denial letter and contact us before deciding how to respond. We’ll explain the insurer’s reasons, check the deadlines and discuss how to challenge the decision. You don’t need every medical record to get started. Read about denied LTD claims.

Should I Appeal Before Speaking With a Lawyer?

Speak with a lawyer first. An internal appeal means asking the same insurer to reconsider its decision. We’ll explain whether more evidence, an appeal or a lawsuit makes sense for your claim. Don’t assume an appeal pauses your deadline to sue. Understand your appeal options.

How Long Do I Have to Challenge an LTD Denial?

Ontario’s basic limitation period is two years from discovery of a claim. When the clock starts and whether an exception applies depend on your situation. Your insurer’s appeal deadline is separate. Contact us promptly so we can check the dates that apply to you.

Can My Insurer Deny LTD for a Pre-Existing Condition?

A health condition you had before coverage began doesn’t automatically rule out benefits. We check your policy’s exclusion, the relevant dates and whether the insurer has applied those rules correctly. Read about pre-existing-condition denials.

How Much Could My LTD Settlement Be Worth?

There’s no set amount. We look at your monthly benefit, missed payments, how long your coverage can continue, deductions allowed by your policy and the evidence showing why you can’t work. We’ll negotiate and explain what any offer means, including future benefits you’d give up.

How Long Does a Disability Claim Dispute Take?

It depends on the evidence we need, how the insurer responds and whether we settle the claim or need to take legal action. Once we’ve reviewed your situation, we’ll explain the next steps and how long they may take.

Will I Have to Go to Court?

Not necessarily. Starting a lawsuit doesn’t automatically mean going to trial. We work to settle your claim through negotiation or mediation and prepare for court if needed. We’ll explain what you’d need to do and support you through the process.

Can I Receive CPP Disability and LTD Together?

You can qualify for both, but each has its own eligibility rules. Your LTD policy may let the insurer deduct CPP Disability payments or ask you to repay some LTD benefits after you receive backdated CPP Disability. We check the policy and the insurer’s calculations. Learn how CPP Disability and LTD interact.

What If My Employer Offers Severance While I’m on LTD?

Talk to us before signing a severance agreement or release. We’ll explain how it could affect your benefits and employment rights. We also help when you’re being pressured to return to work or aren’t getting the accommodation you need. Learn about severance while on LTD.

Can You Help If I’m Unionized?

We may still be able to help with your disability insurance claim. We’ll check your insurance plan and collective agreement to see how we can help. Tell us you’re unionized when you contact us.

Do You Also Handle Short-Term Disability and CPP Disability?

We also help with short-term disability insurance denials and CPP Disability claims. Tell us which benefits you’re having trouble with. We don’t handle ODSP or WSIB claims.
